Rent Freeze/Eviction Ban – Cost of Living (Tenant Protection) (Scotland) Bill
Emergency legislation giving tenants increased protection from evictions and rent increases during the current cost-of-living crisis has now become law. As a result, in-tenancy rent increases have now been capped at 0% - effectively freezing rent prices for tenants both in the social, and private rent sectors, from 6th September 2022 to at least 31st March 2023.
There has also been a moratorium (ban) on evictions from both social and private rented sector properties, effective during the same period.
However, there are exceptions to this, as detailed below
- If a rent increase notification was issued before 6th September 2022
- Where an eviction order or decree was granted before 6th September 2022
- Cases which include anti-social behaviour and criminality
- Cases of abandonmen
- Substantial rent arrears (defined as at least six-months’ worth of rent*)
